Terms of Service

Version 2026-11. OptiqJournal is a product of OptiqWave (“we”, “us”). By creating an account you agree to these terms.

1. Important trading and regulatory disclosures

  • We are not a broker, dealer, investment adviser or commodity trading adviser. OptiqJournal is not registered with the SEC, FINRA, CFTC, NFA or any similar regulator, and does not execute trades, hold funds or securities, or give personalised investment, tax or legal advice.
  • Information only. Statistics, scores and charts (including net P&L, win rate, profit factor, expectancy, drawdown and the edge score) are calculated from the files you import. They are educational and record-keeping tools, not recommendations to buy, sell or hold anything.
  • Past performance does not guarantee future results. Nothing in the service predicts future returns. Trading stocks, options, futures, forex and crypto involves substantial risk of loss, and you can lose more than you invest. Options and futures are leveraged and not suitable for everyone.
  • Results can be wrong. Figures depend on the accuracy and completeness of your broker export and on how we pair fills into trades (for example partial fills, option events, futures multipliers, fees and time zones). Your broker's statements are the official record. Check ours against them, and do not use OptiqJournal as your only record for tax reporting.
  • Taxes. Profit and loss shown is not tax advice and does not apply wash-sale, cost-basis, section 1256 or other tax rules. Consult a qualified tax professional.
  • No broker connection. We never ask for your broker login or API keys. You upload files you export yourself, and you are responsible for having the right to use that data.
  • Your decisions. You alone are responsible for your trading and for complying with the laws, broker agreements and regulations that apply to you.

2. Launch offer eligibility

  • One free promotional period of 6 months is available per person. It starts when you confirm your email address and is counted in calendar months from that moment, using our server time.
  • No credit card is required. We do not create a payment record for the promotion and nothing is charged or renewed automatically. Logging in again does not extend the period.
  • We may refuse, end or reverse promotional access for duplicate accounts, false information or abuse.
  • When the period ends you can still log in, view your trading history and export it. Importing new trades and premium analytics are paused until you choose a paid plan, if we offer one. Paid plans, prices and features will be announced before your period ends and you are never charged unless you choose one.
  • We may change or end the launch offer for new users at any time. Accounts already activated keep their stated period.

3. Your account

You must be at least 18 and able to form a binding contract. Provide accurate information, keep your password secure and tell us promptly about unauthorised use. You are responsible for activity on your account. The service is not offered where its use would be unlawful.

4. Your data

You own the trades, notes and files you upload. You grant us a limited licence to store, process and display them only to run the service for you. You can export your data at any time and delete it from Settings. After expiry of the promotion we keep your history so you can view and export it; you can ask us to delete your account at any time.

5. Acceptable use

Do not attempt to access other users' data, probe or disrupt the service, upload malware, resell the service, scrape it at scale, or use it to break the law. We may suspend accounts that do.

6. Availability, changes and ending the service

The service is provided as it is during launch. We may change features, and we may suspend or end the service; if we end it we will give reasonable notice and a chance to export your data. We do not guarantee uninterrupted or error-free operation.

7. Disclaimers and liability

To the maximum extent permitted by law, the service is provided “as is” without warranties of accuracy, fitness for a particular purpose or non-infringement, and we are not liable for trading losses, lost profits, tax outcomes or indirect or consequential damages arising from your use of it. Where liability cannot be excluded, our total liability is limited to the amount you paid us in the 12 months before the claim (which is zero during the free promotion). Some jurisdictions do not allow these limits, so they apply only as far as the law permits.

8. General

OptiqWave operates in the United States. These terms are governed by United States law and the laws of the State of California, and disputes go to the state or federal courts located in California, unless your local consumer law says otherwise. The service is directed to users in the United States. We may update these terms; for material changes we will notify you by email or in the app, and continued use after the effective date means you accept them. Contact: support@optiqwave.com.
